ACTIVITY PARTICIPATION WAIVER AND RELEASE OF LIABILITY

READ THIS DOCUMENT CAREFULLY. IT IS A LEGALLY BINDING AGREEMENT. By clicking "I Agree," joining any activity, or using the CIWILD Platform to participate in any outdoor activity, you confirm that you have read, understood, and agree to all terms of this Waiver. If you do not agree, do not join any activity through the Platform.

1. INHERENT RISKS OF OUTDOOR ACTIVITIES

I acknowledge and understand that outdoor recreational activities — including but not limited to hiking, trail running, camping, rock climbing, bouldering, kayaking, paddleboarding, mountain biking, backpacking, and wilderness exploration — involve inherent and significant risks that exist regardless of the level of care exercised by any Organizer, guide, or platform.

These risks include, but are not limited to:

  • Serious physical injury, including broken bones, lacerations, head injuries, and permanent disability
  • Death
  • Medical emergencies, including altitude sickness, heat stroke, hypothermia, and dehydration
  • Unpredictable and severe weather conditions
  • Encounters with wildlife or insects
  • Getting lost or stranded in remote or wilderness areas
  • Falls on uneven, slippery, or steep terrain
  • Drowning or water-related hazards
  • Equipment failure or malfunction
  • Negligent conduct by other Participants or the Organizer
  • Emergency response delays due to remote location

2. VOLUNTARY ASSUMPTION OF ALL RISKS

I voluntarily choose to participate in outdoor activities arranged through the CIWILD Community Platform with full knowledge of the risks involved. I freely and expressly assume all risks — known and unknown, foreseeable and unforeseeable — associated with my participation in any activity arranged through the Platform.

I represent and confirm that:

  • I am 18 years of age or older
  • I have independently reviewed the activity listing, including its stated difficulty level, required gear, physical demands, and any special requirements
  • I have honestly evaluated my own physical fitness, skill level, and experience as they relate to the activity
  • I am making a free and informed decision to participate

3. RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in activities arranged through the CIWILD Platform, I, on behalf of myself, my heirs, legal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue:

  • CIWILD Community and its operator, Wuhan Boying Technology Co., Ltd., including its officers, directors, employees, agents, and affiliates
  • The individual Organizer of the specific activity I am joining
  • Any landowners, land managers, or property owners whose land or facilities are used in connection with the activity

from any and all claims, demands, causes of action, damages, losses, costs, and liabilities of any nature — including claims arising from the negligence of any released party — that arise out of or are in any way connected with my participation in any activity arranged through the Platform.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless CIWILD Community, its operator, officers, directors, employees, agents, and affiliates from any loss, liability, claim, damage, or expense (including reasonable attorneys' fees) arising out of or in connection with my participation in any activity, or my breach of any term of this Waiver.

5. EMERGENCY MEDICAL AUTHORIZATION

In the event of a medical emergency arising during any activity, I authorize the Organizer and/or emergency personnel to obtain and provide emergency medical treatment on my behalf. I accept full responsibility for all medical costs, expenses, and liabilities incurred as a result of such treatment.

6. ACKNOWLEDGMENT OF CIWILD'S ROLE

I understand and acknowledge that:

  • CIWILD Community is a technology platform only. CIWILD does not organize, operate, lead, supervise, or vet the safety of any activity listed on the Platform.
  • Activity Organizers are independent individuals acting entirely on their own behalf. They are not employees, agents, contractors, or representatives of CIWILD.
  • CIWILD has no ability to monitor, control, or guarantee the safety, conduct, or quality of any activity arranged through the Platform.
  • Any dispute arising from my participation in an activity is between me and the Organizer directly. CIWILD is not a party to that dispute.

7. MEDIA RELEASE

I grant CIWILD Community and the activity Organizer a non-exclusive, royalty-free license to use photographs, video footage, or other media captured of me during any activity for Platform promotional and operational purposes. If you do not consent to this, please notify the Organizer and CIWILD in writing at info@ciwild.com before the activity takes place.

8. SEVERABILITY

If any provision of this Waiver is held to be invalid or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall remain in full force and effect. This Waiver is intended to be given the broadest possible effect permitted under applicable law.

9. GOVERNING LAW AND JURISDICTION

This Waiver shall be interpreted and enforced in accordance with applicable law. Users located in the United States acknowledge that CIWILD is operated from the People's Republic of China, and that enforcement of any judgment against CIWILD may require legal proceedings in China.

10. CONFIRMATION

BY CLICKING "I AGREE" OR BY JOINING ANY ACTIVITY THROUGH THE CIWILD PLATFORM, I CONFIRM THAT:

  • I have read this Waiver in its entirety and understand its contents
  • I understand that I am giving up substantial legal rights, including the right to sue CIWILD for negligence in connection with any activity
  • I am 18 years of age or older and have full legal capacity to enter into this agreement
  • I am signing this Waiver voluntarily and without coercion
